Amity OS Platform

These Terms of Service (“Terms”) govern your use of the Amity OS platform and any related services. Please read them carefully.

1. Definitions

For the purposes of these Terms:

  • “Amity OS”, “the Platform”, “we”, “us”, or “our” means the technology platform that provides booking, messaging, and relationship management tools for independent health professionals.
  • “Tenant Instructor” means the independent health professional or studio you are booking with through the Platform (for example, Amity Pilates).
  • “End User”, “you”, or “your” means the individual using the Platform to book classes or services with a Tenant Instructor.
  • “Services” means the booking, messaging, payment, onboarding, and related functionality made available through the Platform.
  • “Content” means information, text, messages, images, data, or other materials submitted or generated through the Platform.

2. Relationship between the parties

2.1 Platform role

Amity OS provides the technology infrastructure that enables Tenant Instructors to manage bookings, payments, communications, and client relationships.

Amity OS:

  • does not provide health, fitness, medical, or therapeutic services;
  • does not employ Tenant Instructors;
  • is not a party to any contract for services between you and a Tenant Instructor.

2.2 Tenant Instructor role

The Tenant Instructor:

  • is solely responsible for delivering services to you;
  • sets pricing, schedules, cancellation policies, and class content;
  • is responsible for assessing your suitability for participation.

Any dispute relating to the quality, safety, or delivery of services should be raised directly with the Tenant Instructor.

3. Eligibility and access

  • You must be at least 18 years old to use the Platform unless otherwise permitted by the Tenant Instructor.
  • You agree to provide accurate and up-to-date information when registering and using the Platform.
  • Access to the Platform is provided using one-time authentication codes rather than passwords. You are responsible for maintaining control of your device and contact details.

4. Bookings, credits, and payments

4.1 Bookings

  • Bookings are made with the Tenant Instructor via the Platform.
  • Availability, capacity, and waitlists are determined by the Tenant Instructor.
  • Booking confirmation does not guarantee service delivery if the Tenant Instructor reasonably cancels or reschedules.

4.2 Credits and packs

  • Some Tenant Instructors offer prepaid credit packs.
  • Credits have no cash value, are non-transferable, and may expire or be forfeited in accordance with the Tenant Instructor’s policies.
  • Credit usage and balances are displayed for convenience but remain subject to the Tenant Instructor’s records.

4.3 Pay on the day

  • Some Tenant Instructors may allow “pay on the day” bookings at their discretion.
  • Failure to attend or pay may result in this option being withdrawn.

4.4 Payments

Payments are processed by third-party payment providers. Amity OS does not store full payment card details.

5. Cancellations, late cancellations, and no-shows

Cancellation rules are set by the Tenant Instructor and may include:

  • time-based cut-offs for refunds or credit returns;
  • forfeiture of credits for late cancellations or no-shows;
  • restrictions on future bookings following repeated non-attendance.

You agree that attendance and cancellation records may be used by the Tenant Instructor to manage their business fairly.

6. Health, safety, and suitability

6.1 Health information

You may be asked to provide health and safety information, including Par-Q responses or related details.

You confirm that:

  • information you provide is accurate and complete to the best of your knowledge;
  • you will update relevant information if your circumstances change.

6.2 Responsibility

You acknowledge that participation in physical activity carries inherent risks.

Nothing in these Terms limits liability for death or personal injury caused by negligence where such liability cannot be excluded under UK law.

7. Personalisation and additional information

7.1 Optional information

The Platform may invite you to provide additional information about your lifestyle, goals, preferences, or activity patterns to help your Tenant Instructor personalise their service.

Providing this information is optional unless otherwise stated.

7.2 Purpose

This information is used to:

  • improve class recommendations and scheduling;
  • support consistency and attendance;
  • help the Tenant Instructor tailor services appropriately.

8. Data use and permissions

8.1 Relationship data

Information you provide to a Tenant Instructor is primarily used to support your relationship with that instructor.

8.2 Platform analytics

Amity OS may use anonymised and aggregated data across tenants to:

  • improve the Platform;
  • understand usage patterns;
  • develop new features.

Amity OS does not sell identifiable personal data.

8.3 Marketing and recommendations

  • You will only receive marketing communications if you have opted in.
  • Any recommendations or partner offers will be presented in a contextual and non-intrusive manner and may be declined at any time.

9. Communications

You agree that Amity OS and the Tenant Instructor may contact you via:

  • SMS
  • WhatsApp
  • Email

For purposes including:

  • authentication
  • booking confirmations
  • reminders
  • important service updates

Marketing communications are optional and subject to your consent preferences.

10. Acceptable use

You agree not to:

  • misuse the Platform;
  • provide false or misleading information;
  • interfere with the operation or security of the Platform;
  • harass or abuse Tenant Instructors or other users.

We may suspend or restrict access if these Terms are breached.

11. Intellectual property

All intellectual property in the Platform belongs to Amity OS or its licensors.

You are granted a limited, non-exclusive, non-transferable right to use the Platform for personal, non-commercial purposes.

12. Suspension and termination

We may suspend or terminate access to the Platform:

  • to comply with legal obligations;
  • to protect users or the integrity of the Platform;
  • in cases of misuse or repeated breaches.

Termination does not affect any rights or obligations accrued prior to termination.

13. Disclaimers

The Platform is provided on an “as is” basis.

We do not guarantee uninterrupted or error-free operation and do not warrant outcomes from services delivered by Tenant Instructors.

14. Limitation of liability

To the fullest extent permitted by law:

  • Amity OS is not liable for indirect, incidental, or consequential losses;
  • liability relating to services provided by Tenant Instructors rests with those instructors.

Nothing in these Terms limits liability that cannot lawfully be excluded.

15. Changes to these Terms

We may update these Terms from time to time.

If changes are material, we will notify you and may require re-acceptance before continued use.

16. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
